Disneyland vs PKNS land - Pieter D'Cruz

It has been two days since the exposé of the shady dealings between Khalid Ibrahim, the Selangor Menteri Besar and Azmin Ali, the Deputy President of PKR over a piece of PKNS land in Section 52, Petaling Jaya. Two days and not a single word from either of them. The silence is deafening.

When Khir Toyo, the previous Menteri Besar, was alleged to use state funds to pay for a trip to Disneyland, PKR leaders went to town crying thief. Yet when the present Menteri Besar gave away PKNS land to a crony, the PKR leadership chooses to be quieter than a church mouse.

If the trip to Disneyland was brought to SELCAT, then shouldn’t the giving away of PKNS land merit the same treatment? What’s good for the goose is good for the gander. Unless, of course, one believes that corruption is kosher once blessed by a leader sent by God.

And they have the audacity to promise 10 reforms within 100 days if given the powers to govern the country. The only change to Selangor, a state that they have ruled for more than 1000 days, is a new line-up of cronies.

Yes, it’s the season for giving and forgiving but, no, giving away a piece of land owned by the rakyat is not on my gift list and hypocrites are not on my list of people to be forgiven.

Khalid & Azmin, minta jawab segera - Jaspal Singh Gill

Dua hari lalu saya telah menulis tentang dilemma yang saya hadapi untuk memutuskan mana satu untuk diundi pada pilihanraya yang akan datang – BN atau PR?

Hari ini, dakwaan telah dibuat melalui sebuah portal berita internet tempatan bahawa kerajaan negeri Selangor yang diterajui oleh PR telah meluluskan tanpa tender satu kontrak bernilai berjuta ringgit kepada sebuah syarikat yang tidak mempunyai track record untuk membangunkan sekeping tanah di Petaling Jaya. Juga didakwa syarikat itu mempunyai hubungan rapat dengan YB Azmin Ali, ahli dewan undangan negeri Hulu Kelang yang juga timbalan presiden PKR dan beliau telah mendesak YAB Tan Sri Khalid Ibrahim, menteri besar Selangor, untuk memberi kontrak itu kepada syarikat tersebut.

Ini adalah dakwaan-dakwaan yang amat serius. YAB Khalid and YB Azmin mempunyai kewajipan untuk memberi jawapan dan penjelasan dengan serta merta. Keikhlasan mereka untuk menegakkan integriti, kebertanggungjawaban dan ketelusan kerajaan negeri, PKR dan PR sekarang menjadi bahan persoalan.

Saya berharap kedua-duanya tidak akan membisu sebagaimana parti mereka telah membisu apabila ditimbulkan dakwaan oleh ahli-ahli parti mereka sendiri berkaitan kepincangan pemilihan parti. Berdiam diri sedemikian hanya akan menambahkan kejelakan terhadap PKR.

Saya juga berharap parti-parti rakan, PAS dan DAP, akan mendesak kerajaan negeri Selangor untuk menjawab dakwaan-dakwaan terbaru ini. Desakan sedemikian adalah wajar sekiranya benar PR adalah gabungan sama rata antara parti-parti rakan.

Tidak ada gunanya berjanji untuk reformasi itu dan reformasi ini dalam tempoh 100 hari jika dipilih membentuk kerajaan federal sekiranya suatu perkara yang seratus-peratus di bawah tanggungjawab kerajaan negeri, seperti isu ini, lembab dan keberatan untuk ditangani oleh PR.

Saya harap kerajaan negeri Selangor atau YAB Khalid atau YB Azmin akan memberi penjelasan sebelum Hari Krismas. Sekiranya tidak, maka saya beserta keluarga dan sahabat handai akan mengambil keputusan untuk tidak mengundi PR pada pilihanraya yang akan datang.

Para pengundi sedang menyaksi – dan menunggu.

Khalid & Azmin, please respond immediately - Jaspal Singh Gill

Only two days ago I had written about the dilemma that I have as an ordinary voter in deciding between BN or PR in the next general elections.

Today, it has been alleged through a local internet news portal that, first, the PR state government of Selangor has awarded without open tender a multi-million ringgit contract to develop a piece of Petaling Jaya land to a company with no known track record of property development and, second, the company is associated with the state assemblyman for Hulu Kelang, YB Azmin Ali who is also the deputy president of PKR and, third, YB Azmin had pressured the Selangor menteri besar, YAB Tan Sri Khalid Ibrahim, to award the contract to the said company.

These are very serious allegations. YAB Khalid and YB Azmin have an obligation to respond to them without delay. Their sincerity about upholding the integrity, accountability and transparency of the state government, PKR and PR are at stake here.

I hope neither one would stonewall these allegations the way their party did to accusations by party members of irregularities in their recent internal elections. Such reticence would only cause more disenchantment with PKR.

I also hope its coalition partners, PAS and DAP, would prod the state government to reply to the allegations. Such prodding is the right thing to do if PR is truly a coalition of equals.

There is no point in promising to do this or that reform within 100 days of being elected the federal government if PR drags its feet over a matter, such as this, which is fully under the responsibility of a PR state government.

I hope the state government or YAB Khalid or YB Azmin will give an explanation before Christmas. Otherwise, I together with my family and friends will decide not to give our votes to PR in the next general elections.

The voters are watching.

Cross your ballot and then your fingers? - Jaspal Singh Gill

The recent Pakatan Rakyat (PR) convention has unveiled a list of ten items that a PR government would accomplish within its first 100 days of governing the country. And what a welcomed list of it is. Most, if not all, of those items are good things; very desirable things that no one would argue against. You’d be a fool to do so.

However, upon greater reflection, you can’t help but feel you’d be a bigger fool to decide here and now to give your vote to them solely on account of what they promise to do. They are after all politicians on a campaign and we all know the thing about campaign promises – they’re not worth the paper they are written on.

But what I found particularly risible is that one of the political parties making the promise of institutional reforms is PKR which since March 2008 has shown itself barely able to keep its own house in order.

The party’s own recent internal elections had been so poorly conducted it has become a showcase of sham and shambles. This was compounded by the less than enlightened attitude of the party towards those within its fold who criticised and highlighted the flaws in the process; so much so that one frustrated candidate decided to abandon contest and party altogether.

Apart from vote-rigging, leakage of ballot papers, furtive pressure on some unfavoured candidates to withdraw, among other reports of abuses in the party elections, there was even an alleged case of letter forgery with the intent of nullifying a member’s nomination to contest. With all these examples of either malice or incompetence now in public awareness, the party has the cheek to hold itself out to be the one eminently suited to undertake the reform of the nation’s vital institutions. If there is one thing that the PKR elections ought to teach all of us is that good intentions alone is not enough to bring the outcome that we want.

Many will of course argue that the incumbent BN government is a prime example of poor governance and ought to be voted out no matter what. Maybe so except that the alternative, especially PKR, has quite amply shown itself prone to poor governance even before it has taken over the reins of government, what more if it became the government.

To believe that there is no alternative to BN would be to give it full license to perpetuate the abuse of its mandate but to believe that PR, especially PKR, ought to be voted in no matter what, is to give full license to it to ignore its own flaws and shortcomings. There is no surer way to turn it into another Umno/BN once it is in power. Therein lies the dilemma for the non-politically affiliated voters amongst us.

There is the counter-argument that if PR is not up to the mark whilst in government, we, the voters, can always vote it out come the next general elections. Such an argument is based on the premise that Malaysia is a ‘perfect’ democracy. That is a premise not borne out by what has been observed of both the governing and opposition parties in action.

It is indeed a tough call and the last thing I would want to do is swallow the PR pledge of ‘100-day’ reforms hook, line and sinker.

The closet gay and the XDPMILF syndrome - Pieter D'Cruz

It didn’t surprise me one bit our neighbour’s intelligence services’ finding that Anwar Ibrahim “did indeed commit the acts for which he is currently indicted”. It concurs with the finding of the Federal Court, dated 2 September, 2004, that Anwar Ibrahim did indeed engage in homosexual activities.

It is hard for the general public to accept the fact that Anwar is a homosexual because of his image as a pious Muslim and the circumstances of the charges against him. Most people can’t visualize how a 63-year old man (with a bad case of backache) could force himself on a 23-year old man. It boggles the mind so much so that it’s a lot easier to accept that the charges are part of the political conspiracy to destroy Anwar Ibrahim.

Perhaps, a change in perspective of the said homosexual activities could enlighten the general public. The dominant person needs not use force to rape his victims. He seduces them. Initially, he was not the giving end, he was the receiving end. He was the “queen”. Only later in the relationship would the roles be interchangeable.

The victims were very vulnerable to the dominant person’s advances because of his stature. It is a case of rape by a person of authority. Most of his victims are young men of low social standing such as his driver, his coffee-boy, etc. They were overwhelmed by the XDPMILF syndrome i.e. “eX-Deputy Prime Minister I Like to F**k” syndrome.

As a liberal, I don’t give a damn about a person’s sexual orientation. I don’t care a bit if my mechanic is gay, as long as he could repair my car. I don’t give a s**t if my golf-caddy is a lesbian, as long as she could perform the duties I paid her for.

But in the case of Anwar Ibrahim, it’s totally a different kettle of fish. This guy wants to be the Prime Minister and he may well be a closet gay. As a Prime Minister, he would be a victim of blackmail by foreign governments and we would suffer for that. Furthermore, he started his political career as an activist of political Islam and even now holds himself out to be a champion of moderate Islam. The hypocrisy stinks to high-heaven.

All this while he has been denying to the public that he indulges in homosexual activities, claiming it to be a fabricated lie. Do we want another liar as a Prime Minister?

And if Anwar Ibrahim is a closet gay, what’s there to prevent him from being a closet despot?

Wikileaks and the PKR response - Wan Nasuha

The Wikileaks expose on what Singapore officialdom thinks of its Malaysian counterparts and politicians, both government and opposition, have been unflattering to the latter. To most Malaysians, that’s not surprising. We too have dim views of our politicians.

The Singaporeans are of the view, among others, that our country lack competent leadership, that Najib Razak continues to be haunted by a murder scandal and that nobody likes Khairy Jamaluddin because he got where he is through family ties. So what else is new? That sounds blasé but it does not mean we don’t expect those in government to address one or two of the above issues. We do and they should - Wikileaks or no Wikileaks.

Parti Keadilan Rakyat (PKR) however appears to be particularly stung by the revelation that Lee Kuan Yew and his intelligence services have told the Australian Office of National Assessments that Anwar Ibrahim, the party’s de facto leader, 'did indeed commit the acts for which he is currently indicted'. Apart from the ongoing sodomy trial, a leader who is ‘God’s gift’ to the people should never ever be pictured to be engaged in homosexual sex. Hence, the indignant responses that followed from the party.

The whole thing, however, is in the nature of ‘overheard conversations’ and this complicates matters quite a bit. Had the Singaporeans or Aussies or Americans trumpeted out loud that ‘Anwar did it’, it would have been a bit easier to deal with.

As it was, we weren’t supposed to know but we knew anyway, thanks to Wikileaks and the thing is, people tend to be more honest and frank in private conversations than in public. Consequently, the party’s responses, apart from being indignant, have also been silly.

As expected, there is the almost obligatory ‘we-are-the target-of-a-conspiracy’ response, such a conspiracy this time is between the Malaysian and Singaporean secret police.

And as usual, no evidence was provided to support this claim. Suffice it seems that it is well-known there had been police co-operation in the past between the two countries. The implication is also that the Singaporean side would just swallow everything that the Malaysian Special Branch fed them about Anwar. I leave that to the reader to decide on its plausibility.

Moreover, we only knew what the Singaporeans think of Anwar through Wikileaks. Does this then mean that Julian Assange is part of the conspiracy against PKR and Anwar? Well, that’s bound to give a few moments of mirth to Assange in the gloom of his British lock-up.

And what about the two Australian newspapers which published the revelations on Anwar? They too must be co-conspirators, going by PKR’s logic.

Asking that the precise nature of the ‘technical intelligence’ to be explained to the public may sound good but it is actually very silly. Those involved in gathering the said information are not paid to justify their findings to the public but only to their political masters which, in this case, is the Singapore government who will see even less reason to engage with the Malaysian public in a discussion over operational intelligence matters.

Finally, yes, much of what is exposed is in the realm of personal opinions. But there are personal opinions and there are personal opinions. A finding or conclusion reached on the straightforward question of ‘did he or didn’t he’ has to be based on facts and a conclusion conveyed in private and confidential communication carries with it the presumption of being frank and honest, unless otherwise proven.

And it’s these two characteristics of the disclosure I believe that is causing so much angst within PKR right now.

Kisah mata lebam dan surat palsu: Niat jahat + Ketekunan Melampau = Perbuatan Jenayah - Malcolm Puthucherry

Pada hari bersejarah September 1998 itu, ketika Anwar Ibrahim dihadapkan ke mahkamah dengan bermata lebam dan muka baru lepas kena hentam semasa dalam tahanan polis, saya merasakan reputasi Malaysia di persada dunia jatuh ke tahap yang teramat rendah. Amat memeranjatkan apabila perbuatan ini berlaku dalam tempat dan lingkungan mereka yang diberi kepercayaan menegakkan undang-undang, tetapi apabila ia melibatkan ketua polis negara, perasaan marah yang meluap-luap tidak dapat dibendung lagi.

Memang benar, pesalah telah dijatuhkan hukuman oleh mahkamah dan dia telah menjalankan hukumannya tetapi selepas lembaran terakhir episod hitam ini diselak, timbul juga tanda-tanya mengenai keadaan persekitaran ketika itu dan tata pemikiran (mindset) para pemain dalam ‘wayang’ ini yang berakhir dengan episod ‘mata lebam’.

Ibukota Kuala Lumpur digemparkan dengan tunjuk perasaan besar-besaran yang dipanggil oleh Anwar. Lebih dari 100,000 orang hadir pada tengahari tersebut, suatu jumlah yang tidak pernah dilihat sebelum ini, untuk turut serta dalam sebuah perhimpunan yang diharamkan pihak polis. Pada petang hari yang sama, pihak polis tanpa ragu-ragu lagi terus menangkap Anwar. Rekod perbicaraan mengesahkan bahawa di keheningan malam hari bersejarah itu, Anwar ditutup matanya, digari tangannya dan ditibai bertubi-tubi oleh Ketua Polis Negara.

Begitu mudah sekali sikap profesional untuk memandang setiap pesalahlaku undang-undang dengan hina, bertukar menjadi niat jahat yang dikhususkan untuk seorang. Barangkali demonstrasi besar-besaran yang diadakan pada hari itu dilihat sebagai tindakan mencabar kuasa dan autoriti polis, maka si pesalah itu wajib menerima balasan secukup-cukupnya.

Gabungkan niat jahat tersebut dengan ketekunan berlebih-lebihan untuk memuaskan kehendak ‘tuan’, tidak kiralah samada ‘tuan’ itu merujuk kepada negara, menteri, atau ego sendiri, ditambah lagi dengan sifat keperibadian diri seperti menggunakan kekerasan untuk menyelesaikan masalah, hasilnya satu kombinasi keadaan yang mengundang bencana.

Maka, terhasillah insiden ‘mata lebam’, bukan sahaja buat Anwar tetapi juga buat Malaysia.

Akan tetapi, jenayah sebesar itu tidak akan berlaku secara tiba-tiba dan tersendiri, dengan tiada sejarah lampau disebaliknya. Pendek kata, perbuatan jenayah yang besar lazimnya dilakukan oleh seorang penjenayah yang dahulunya pernah melakukan jenayah secara kecil-kecilan tanpa dikenakan hukuman. Kata kunci di sini ialah ‘tanpa dikenakan hukuman’. Itulah sebabnya setiap organisasi, masyarakat dan negara berusaha mengenalpasti pesalah dan penjenayah dikalangan mereka, lantas menjatuhkan hukuman yang setimpal ke atas pesalah dan penjenayah ini. Perbuatan sewenang-wenang mereka melanggar undang-undang mesti dihukum, setidak-tidaknya untuk memastikan mereka tidak terdorong untuk melakukan jenayah yang lebih besar, sehingga menyebabkan semua orang ‘bermata lebam’.

Kita sebagai masyarakat madani juga wajib mengutuk pihak-pihak yang membiarkan sahaja jenayah dan salahlaku dari berlaku, walau kecil sekelumitpun perbuatan terkutuk itu. Perasaan takut amat mudah dijadikan alasan untuk menghalang kita dari mengutuk perbuatan ini, tetapi malanglah kita sebagai masyarakat sekiranya kita membiarkan sahaja pemimpin yang kita percayai melakukan salahlaku dan jenayah.

Ini mengingatkan saya kepada kes surat yang dikeluarkan oleh Parti Keadilan Rakyat (PKR) untuk memecat keahlian salah seorang Timbalan Setiausaha Agungnya. Kita semua maklum surat itu didakwa sebagai palsu.

Andaikata surat tersebut palsu, adakah wujud persamaan keadaan (circumstantial parallels) antara kes surat palsu ini dan kes mata lebam 1998?

Pertama: parti kini berhadapan dengan pemilihan parti secara ‘satu ahli, satu undi’ untuk memilih pucuk pimpinan di peringkat bahagian dan pusat, suatu perkara yang belum pernah disaksikan sebelum ini. Pada 1998, negara menyaksikan suatu demonstrasi besar-besaran yang belum pernah disaksikan sebelum itu. Nampaknya ada persamaan.

Kedua: Bekas Timbalan Setiausaha Agung parti diragui terlibat dalam kegiatan menentang parti. Beliau melahirkan rasa tidak puas hati beliau dengan mengingkari arahan pimpinan parti untuk tidak mengambil bahagian dalam pemilihan jawatan Timbalan Presiden parti. Pada 1998, Anwar dipecat dari kerajaan dan partinya. Beliau melahirkan rasa tidak puas hati beliau dengan mengadakan tunjuk perasaan umum di seluruh pelusok negara. Nampaknya, ada persamaan juga.

Seterusnya, apakah tata pemikiran para pemain dalam ‘wayang’ PKR baru-baru ini? Mungkinkah sikap profesional untuk memandang setiap pesalahlaku undang-undang dengan hina, telah bertukar menjadi niat jahat yang dikhususkan untuk seorang? Itu sudah tentu, kerana orang itu sudah menjadi topik perbincangan dalam mesyuarat rasmi yang sedang mempertimbangkan tindakan disiplin keatasnya. Orang itu tidak segan-silu dengan pendirian beliau dahulu yang menentang parti, tetapi kini dengan selamba pula menawarkan diri untuk bertanding jawatan yang lebih tinggi dalam parti yang amat dibencinya.

Mungkinkah ada ketekunan berlebih-lebihan oleh mereka yang telah diberi kepercayaan untuk mengenakan tindakan terhadap orang ini, sepertimana adanya ketekunan berlebih-lebihan dari Ketua Polis yang menggunakan penumbuk tangannya sendiri pada 1998? Sekali lagi, nampak seperti ada persamaan juga. Tidak syak lagi, pimpinan parti rata-rata merasakan bekas Timbalan Setiausaha Agung itu telah membatalkan kelayakannya untuk bertanding berdasarkan pendirian dan perbuatannya yang lampau. Maka, wujudlah ketekunan berlebih-lebihan dalam pentadbiran pusat parti yang ingin mencari sebab untuk menamatkan riwayat politik bekas Timbalan Setiausaha Agung ini.

Akan tetapi, bagaimanakah pentadbiran pusat parti bercadang untuk menjayakan usaha ini? Minit mesyuarat bagi Majlis Pimpinan Pusat serta Biro Politik tidak mengandungi sebarang resolusi atau persetujuan untuk mengenakan tindakan disiplin terhadap individu ini. Pecat dari Parti? Jauh sekalilah.

Semua ini berakhir dengan insiden ‘mata lebam’ versi PKR: salinan sepucuk surat bertarikh Febuari 2009 ‘dijumpai’ dalam fail simpanan Parti. Kandungan surat ini memecat bekas Timbalan Setiausaha Agung itu dari menjadi ahli parti dengan serta-merta.

Penandatangan surat tersebut, seorang bekas Setiausaha Agung sudahpun membuat laporan polis menyatakan surat tersebut adalah pemalsuan ‘potong dan tampal’, dan mungkin wujud penyalahgunaan tandatangan elektronik beliau yang ada dalam simpanan parti. Beliau mengesahkan melalui afidavit bahawa beliau tidak tahu langsung mengenai kewujudan surat tersebut dan kandungan surat tersebut tidak pernah mendapat persetujuannya.

Kesemua bukti yang sedia ada menyokong kes bekas Timbalan Setiausaha Agung ini: minit mesyuarat parti pada Ogos 2009, iaitu 6 bulan selepas surat pemecatannya kononnya dikeluarkan menunjukkan beliau masih seorang ahli parti pada tarikh mesyuarat tersebut; perlembagaan parti tidak membenarkan Setiausaha Agung secara bersendiri memecat mana-mana ahli. Lebih menghairankan, surat pemecatan itu langsung tidak menyatakan bilakah pimpinan parti bermesyuarat membuat keputusan untuk memecat beliau. Seorang lagi bekas Timbalan Setiausaha Agung yang bertanggungjawab ke atas hal-hal disiplin menyatakan beliau tidak pernah mengarang surat tersebut, dan hal pemecatan tersebut tidak pernah dibawa untuk perhatian beliau.

Parti nampak bisu seribu bahasa dalam hal ini. Reaksi pimpinan parti setakat ini terhad kepada bersikap pura-pura tidak tahu asal-usul sebenar surat pemecatan itu dan menyerang mana-mana ahli yang ingin menjernihkan keadaan. Reaksi sebegini memberi tanggapan seolah-olah parti tidak sedar, atau sengaja tidak mengendahkan kesan insiden ini terhadap reputasi parti dan pemilihan ‘1 ahli 1 undi’ yang baru sahaja berakhir.

Adakah pihak parti berharap isu ini akan dikategorikan sebagai ‘kesalahan kecil’ yang dilakukan oleh kakitangannya yang tidak cekap? Jika parti berharap sedemikian, habislah kita. PKR ialah organisasi politik yang berhasrat mengambil alih pemerintahan negara. Apabila pesalah walau sekecil mana kesalahannya sekalipun dibiarkan bebas tanpa sebarang tindakan, pesalah ini lambat laun akan melakukan kesalahan dan jenayah yang lebih besar dan serius, terutamanya apabila mereka ini dibenarkan memegang lebih kuasa dan autoriti. Belum sempat mentadbir negara, PKR sudah ‘menghalalkan’ ahli dan kakitangannya melakukan kesalahan jenayah tanpa dikenakan tindakan. Saya gusar jenayah apa pula yang akan mereka lakukan apabila diberi kepercayaan memerintah negara kelak.

Reformis yang memperjuangkan demokrasi dapat mengenali persamaan dalam kes surat palsu dan kes mata lebam: penyalahgunaan kuasa oleh pihak berkuasa untuk melenyapkan suara-suara ‘sumbang’ yang membangkitan isu yang tidak sedap didengar. Pelenyapan dibuat dengan cepat secara tidak halal.

Adalah menjadi tanggungjawab Anwar, dahulunya mangsa ketekunan berlebih-lebihan dalam kes ‘mata lebam’, untuk memastikan insiden sebegini tidak berlaku dalam kepimpinannya. Sebaliknya, beliau menyuruh kuncu-kuncunya yang rata-ratanya berotak udang untuk menerangkan kepada umum bahawa pemecatan tersebut, secara politiknya adalah tindakan yang betul. Tetapi, itu bukan isunya. Isu sebenar ialah kebejatan prinsip ketelusan dalam pentadbiran sebuah parti reformis; kebejatan sama yang sering diungkit PKR untuk mengkritik kerajaan pemerintah.

Berita baiknya ialah kerajaan kini sedang membuka semula kes mata lebam 1998. Seorang pemberi maklumat yang telah bersara dari struktur kuasa pada masa itu telah membongkar salahlaku-salahlaku yang berlaku semasa penyiasatan. Sudah menjadi lumrah manusia untuk sentiasa berwaspada memastikan perkara-perkara yang mendapat perhatian khalayak awam dibuat secara tertib dan sah.

Adalah wajar bagi PKR mengendalikan isu surat palsu ini secara serius dengan memulakan penyiasatan dalaman secepat mungkin, sekiranya ia tidak mahu menerima mata lebam dari para pengundi dan rakan-rakannya dalam Pakatan kelak.

I read yesterday that Datuk Seri Mohd Khir Toyo has resigned as the Opposition leader of the Selangor state legislative assembly after he was charged by the Anti-Corruption Commission over the purchase of two lots of land and a bungalow in Shah Alam.

I am no big fan of Datuk Seri Khir but I have to admit that it was the honourable course of action that he took in resigning as the state opposition leader. While he is preparing for his trial, it is not likely he can devote much time or attention to his duties as opposition leader. The citizens of Selangor should not be deprived of their right to have an opposition leader in the state assembly who can fully perform his duties. It is quite commendable that Khir has given way to someone else.

I am therefore most puzzled as to why the opposition leader in our federal parliament has not chosen to do likewise. He is presently embroiled in a sodomy trial.

Would it not be more honourable for him to step down as opposition leader, like Khir Toyo, so that he can devote his fullest attention to his trial and allow another MP with much less time-consuming encumbrances to take over?

Maybe the Selangor opposition leader had to resign because he is a ‘God-cursed’ leader whereas the federal opposition leader is a ‘gift from God’ to the people of Malaysia. I really do not know. I hope he or anyone else within the federal opposition circle can answer my question.

Of black eyes & forged letters: Malice + Overzealousness = Criminality - Malcolm Puthucherry

That day in September 1998 when Anwar Ibrahim was produced in court sporting a black eye and a bruised face after being assaulted during police custody was to me the day when Malaysia’s international reputation really hit a nadir. That such lawlessness could have happened within the precincts of those who had been entrusted to uphold the law was in itself shocking; that it was committed by the very person who headed the body so entrusted was an unmitigated outrage.

Yes, the perpetrator was punished in the court of law and had served his sentence but well after the last page has been turned on that dark episode, one just cannot help but wonder about the interplay of circumstances and mindsets that culminated in the ‘black eye’.

KL was rocked by a massive afternoon rally called by Anwar. The size of the rally was estimated to be about a hundred thousand people, simply unprecedented for an event which was banned by the police. The police went on to detain Anwar that very evening. Trial records showed that later in the night while blindfolded and handcuffed he was brutally assaulted by the country’s chief of police.

How easily it was that the professional disdain expected of every policeman for a law-breaker to mutate into malice reserved for one marked person. Perhaps that day’s mammoth rally was viewed as a blatant act of defiance against police authority for which the culprit must be made to pay.

Combine that malice with excessive zeal of one who is expected to abide by the rules in serving his master, whoever or whatever that master may be - country or minister or one’s own ego – and throw in a personal idiosyncrasy, say being prone to resort to force in solving problems and you’ll get an explosive mix indeed.

Thus, was born the black eye, not just for Anwar but also for the whole country.

But a crime of that magnitude could not have happened all of a sudden, in isolation with no evolutionary history. Simply put, a big monstrosity of a crime usually is perpetrated by a culprit who has in the past committed many other smaller crimes with impunity. ‘Impunity’ is the crucial word here. That is why every organization, society, community or nation seeks to identify wrong-doers within its midst and mete out the appropriate penalties against them. Their breaches of the law should not go unpunished lest they’ll be encouraged to commit even greater ones and ultimately give everyone the proverbial black eye.

Woe betide those who turn a blind eye or condone wrongdoings, however small those wrongful acts are. Fear may be an excuse but much less so if those who tolerate the criminal deeds are in positions of consequence bearing the twin burdens of leadership and trust.

Which brings to mind the current case of the alleged fraudulent letter issued by Parti Keadilan Rakyat (PKR) to dismiss the membership of one of its former deputy secretary-generals.

Assuming that the letter was forged, are there circumstantial parallels with the black eye case of 1998?

Yes, the party was in the unprecedented situation of holding ‘one member, one vote’ elections for office bearers at the divisional and national levels. 1998: unprecedented public rally. So, check.

The former deputy secretary-general has been alleged to indulge in anti-party activities and in defiance of the party leadership intended to run for the deputy presidency of the party. 1998: Anwar dismissed from government and party and in defiance, he held public rallies nationwide. So, check again.

What then of the mindset of the protagonists in the PKR case? Could disdain easily turn into malice towards the marked person? Certainly, as the marked person already was the subject of discussions in official meetings contemplating disciplinary action against him. He hardly bothered to hide his past anti-party stand and yet had the cheek to run for higher office in the party he so despised.

Could there have been overzealousness on the part of those who were entrusted to act against this marked person just as there was in 1998 with the police chief who took the law into his own hands? Again yes. The undisputed sentiment within the party’s leadership was that the ex-deputy secretary-general had forfeited his right to run due to his past conduct. This could well have created overzealousness within the party central administration to provide grounds for pulling the rug from underneath him. But how to accomplish that when the party’s own minutes of central leadership or political bureau meetings do not contain any resolution to discipline him, never mind sacking him from the party?

Thus was born PKR’s version of the 1998 Anwar black eye: a letter dated February 2009 informing the ex-deputy secretary-general that he had been sacked with immediate effect from the party was conveniently found within the party’s files of documentation.

The purported signatory of the said letter, a former secretary-general, has already lodged a police report saying that the letter is a cut and paste forgery, maybe even abusing his electronic signature on file. He confirmed by affidavit that the letter had neither his consent nor knowledge.

All available evidence supports his case: party meeting minutes of August 2009 , six months after the date of the purported sacking letter, show that the ex-deputy secretary-general was still a member on the date of the meeting; party constitution does not permit a secretary-general on his own to sack any member and the said letter incredibly did not even state which meeting of the party leadership resolved to sack the ex-deputy secretary-general; a former deputy secretary-general in charge of disciplinary matters has stated he has never drafted such a letter nor was it ever brought to his attention during his tenure.

The reaction of the party leadership, apart from pleading ignorance over the origin of the letter in question and attacking any party member who speaks out of turn, has amazingly been muted. One gets the impression that they are not aware of or are wilfully ignoring the possible implications of the case on the party’s standing and the recent party elections.

Are they hoping that the issue will be labelled a ‘minor misdemeanour’ perpetrated by some incompetent staff? If so, then that is very scary indeed. This is a political organization hoping to capture the reins of government. It is when people are allowed to get away with wrong-doings, no matter how small, that they will sooner or later graduate to commit the even more serious and major crimes, especially when they are given greater authority and power. If PKR allows those in its midst to commit wrong with impunity now before it even governs the country, God knows what greater crimes would be committed if it occupies the seat of government.

Any reformist democrat can discern the parallels in both cases: the abuse of authority of the establishment to remove a voice screaming uncomfortable issues which were not in snyc with the majority in the home turf, by means of an illegal but “expeditious” act.

It is incumbent upon Anwar, having been a victim of such overzealousness in the “black eye” case, to see to it that such a sad episode is not repeated under his watch. Instead, he would have some pea-brained cohorts rationalising by spinning that that sacking is politically desirable. That is missing the point. The point is about transparency of good governance of a reformist party; the very things that PKR has been demanding of the government in power.

The good news to all of us is that the government is re-opening the black eye case of 1998. A whistle-blower retired from the power structure then has divulged administrative and substantive improprieties in the earlier investigation. Take this cue that the people are always conscious and demand that things should always be legal and proper when it touches the public domain.

PKR would do well to treat the issue of the alleged fraudulent letter seriously by having an impartial internal enquiry now, if it does not want to be given a black eye later by the voters and its coalition partners.

Current state of affairs in PKR will affect Pakatan Rakyat - Goh Soon Sin

As a member of DAP and a staunch supporter of PR, I am duly worried by the current state of affairs in PR, especially in PKR. I am wrecked with anxiety over the issue of the forged letter and the implications of that criminal act on PKR specifically and PR generally.

I am convinced that the letter is a forgery based on the affidavit by the former Secretary-General of PKR, the minutes of the MPP meeting on 30 August, 2009 and the statement made by Jonson Chong, a former Deputy Secretary-General of PKR.

The dismal response of PKR leaders to the allegation really amazes me. Instead of conducting an internal inquiry to find out the person or persons responsible for the forgery and taking the appropriate actions to mitigate the consequences of such a criminal act, PKR leaders chose to go into denial mode and politicize the allegation.

The PKR leadership is still insisting that the letter is authentic despite the evidence. They spin the allegation as part of a political conspiracy to destroy PKR. To gain sympathy of the public, PKR, as usual, plays the role of the victim.

Inevitably, the response of the PKR leadership to the allegation of the forged letter reminds me of the response to the sodomy charges against the de-facto leader of PKR. It is one of denial and politicizing the issue.

If a clear cut case of forgery is spun into a political conspiracy, I am starting to have my doubts over the innocence of the de-facto leader in the sodomy case. The PKR leaders have the temerity to forge a letter and, when exposed, start playing victim. Likewise, the de facto leader could have sodomized his personal aide and, when charged, cry political conspiracy.

For a party that claims to fight for justice and transparency, the issue of the forged letter may well be a setback to PKR. I am worried that the negative perception of PKR will affect PR. The public will lose confidence in PR and consequently, diminish the chance of PR winning the GE 13.

It is only strategic for PAS and DAP to start considering PR as a coalition without PKR. PR sans PKR is more appealing to the voters.

Menyokong tindakan Che'GuBard tidak iktiraf pemilihan PKR - Aktivis Reformasi


Aktivis Reformasi menyokong tindakan Sdr Badrul Hisham Shaharin atau lebih dikenali sebagai “Che'GuBard” yang telah membuat pendirian tegas untuk tidak mengiktiraf keputusan pemilihan parti dengan menuntut penjelasan bertulis daripada parti berhubung pelbagai dakwaan manipulasi, penipuan dan salahlaku JPP serta Sekretariat Ibu Pejabat di bawah pimpinan Setiausaha Agung, YB Saifuddin Nasution.

Aktivis Reformasi mendesak keras agar pimpinan parti khususnya Presiden, Datuk Seri Dr Wan Azizah, memberi perhatian serius terhadap tuntutan yang dibuat oleh Che'GuBard. Aktivis Reformasi sangat kesal jika pucuk pimpinan meremeh-remehkan tuntutan Che'GuBard ini. Aktivis Reformasi kini juga sedar bagaimana pucuk pimpinan parti merendahkan tuntutan dari orang bawahan. Pucuk pimpinan harus ingat bahawa orang bawahan inilah yang menyokong parti dengan mengharungi gas pemedih mata, bermandi asid dan dibelasah belantan FRU, terkini dalam demonstrasi isu air Selangor minggu lepas.

Ketika golongan elit bersenang-lenang di keliling Ketua Umum, Che'GuBard memimpin massa meskipun tidak memegang sebarang jawatan tinggi parti dan ditentang polis FRU. Tiada gunanya menjadi pemimpin berjawatan tinggi jikalau tidak berani untuk tampil sebagai pejuang kental ketika semboyan menuntut kita turun di jalanan melawan kezaliman.

Aktivis Reformasi amat bersetuju bahawa politik naungan adalah satu malapetaka kepada perjuangan parti. Politik naungan kini sedang melanda PKR apabila kumpulan-kumpulan yang menjadi elitis di sisi Ketua Umum, dengan biaya kewangan mereka yang sungguh mewah, sedang membentuk barisan kepimpinan parti yang baru.

Aktivis Reformasi juga ingin menyatakan kegusaran tentang budaya politik ampu-mengampu yang selama ini menjadi darah daging UMNO, kini sedang menular, berkembang dan subur dalam PKR. Budaya seumpama ini akan membuatkan parti terpesong dari landasan perjuangan sebenar sebagai sebuah gerakan reformasi rakyat.

Parti hendaklah berwaspada dengan kelompok yang berselindung atas nama reformasi tetapi seumpama lintah darat dengan satu tujuan, iaitu mengambil kesempatan mencari projek dan peluang perniagaan. Kumpulan-kumpulan lintah darat ini sedang berada di sekeliling Dato’ Seri Anwar Ibrahim dan memegang jawatan besar dalam parti. Kumpulan lintah darat ini sedang mengampu pimpinan parti dan mendapat sokongan para-para YB yang lupa diri. Kumpulan lintah darat ini juga mempunyai beberapa YB dalam lingkungannya dan mereka telah dikenalpasti mengampu pimpinan tertentu dan Ketua Umum bagi memastikan dapat bertanding pada pilihanraya umum ke-13 nanti.

Pemilihan secara ‘1 ahli 1 undi’ adalah langkah berani parti untuk menyuburkan demokrasi tetapi hanya jika pemilihan dijalankan dengan telus, adil dan bersih. Justeru itu, jika pemilihan ‘1 ahli 1 undi’ dipenuhi dengan penipuan, manipulasi undi dan amalan politik wang yang berleluasa di sana-sini, maka pemilihan parti tidak membawa apa-apa makna, malah parti akan dilihat berkompromi dengan penipuan dan membenarkan ketidakadilan berlaku dalam parti yang mahu berjuang untuk menegakkan keadilan dan kebenaran.

Aktivis Reformasi mengingatkan pucuk pimpinan parti bahawa gerakan reformasi sedang meneruskan perjuangan tegasnya menuntut keadilan dan ketelusan dari SPR melalui siri Demo Bersih, tetapi dalam masa yang sama PKR sedang membenarkan barisan Majlis Pimpinan Pusat dan Biro Politik parti dibentuk hasil daripada proses pemilihan yang penuh penipuan dan politik wang.

Aktivis Reformasi berjanji akan terus memelihara prinsip-prinsip keluhuran Gerakan Reformasi sebagai sebuah Gerakan Rakyat seperti yang dinyatakan dalam Deklarasi Permatang Pauh, satu gerakan yang diangkat oleh rakyat sebagai agen perubahan pada tanggal 12 September, 1998.

Akhir sekali, Aktivis Reformasi ingin menekankan bahawa perjuangan reformasi adalah perjuangan rakyat dan bukan perjuangan untuk individu tertentu, samada Anwar Ibrahim atau anak-anak emasnya.

Perlantikan Canselor UNISEL - Ridzuan Zakaria

Pada 20 November, Rosmah Mansor telah mengumumkan pengunduran diri dari jawatan Canselor Unisel. Sejak itu berbagai-bagai spekulasi telah timbul mengenai pengganti beliau.

Pada Kongres PKR baru-baru ini, Syed Husin Ali telah dicadangkan sebagai pengganti. Syed Husin, dalam kerasulannya, telah menolak cadangan tersebut. Sebaliknya, Syed Husin penuh dengan semangat anti-feudalisma, telah mencadangkan isteri boss, Wan Azizah Ismail. Mungkin Syed Husin menolak kerana segan-silu dilabel sebagai Canselor masuk pintu belakang seperti cara beliau menjadi Ahli Parlimen.

Tidak kira Syed Husin atau Wan Azizah, perlantikan antara dua tokoh ini akan menjejaskan nama baik Ketua Umum. Jika Syed Husin dilantik, dituduh kronisma; kalau Wan Azizah dipilih, dituduh nepostima.

Ketua Umum, sebagai pendukung wahid reformasi, harus berubah dari pradigma kolot UMNO/BN yang melantik ahli politik yang telah luput tarikhguna atau dari golongan bangsawan yang menganggur untuk menjadi Canselor universiti. Ketua Umum mestilah membuat perlantikan yang luar dari kotak.

Canselor Unisel yang baru wajib mampu membawa perubahan dan kecemerlangan kepada Unisel. Seorang ulama yang berintegriti. Seorang yang lazim dengan persekitaraan menara gading. Seorang dari akademia. Seorang yang tidak mempunyai ‘bagasi lebihan’ di arena politik tanah air tetapi dikenali umum.

Hanya Dr. Mohd Asri Zainul Abidin dapat menemui syarat-syarat tersebut.

Dosa besar Mahathir - Sharifuddin Said

Dosa terbesar Mahathir ialah menafikan hak rakyat Malaysia untuk menikmati khidmat seorang pemimpin ‘anugerah Tuhan’ sebagai Perdana Menteri. Pada September 1998, Mahathir yang takut kehilangan kuasa telah melucutkan jawatan Timbalan Perdana Menteri dari ‘anugerah Tuhan’ ini dan sekaligus menyingkirnya dari UMNO. Kerana tulah ini, Mahathir jatuh tersungkur lima tahun kemudian.

Abdullah Badawi yang mengganti Mahathir pun turut tersungkur kerana tidak memberi laluan kepada ‘anugerah Tuhan’. Kini orang ramai tertanya-tanya berapa lama Najib Razak dapat bertahan sabelum tersungkur akibat tulah kepada ‘anugerah Tuhan’.

Ciri-ciri pemimpin ‘anugerah Tuhan’ ini ialah “karisma, amanah, keberanian, kegigihan dalam perjuangan menegakkan keadilan, kebenaran dan kesejahteraan rakyat, mengenepikan kepentingan peribadi dan keluarga, kesediaan berkorban, memiliki kebijaksanaan (hikmah) dan ketahanan fizikal”. Justeru itu, jawatan Perdana Menteri ialah hak kelahiran ‘anugerah Tuhan’ ini.

Bayangkan jika ‘anugerah Tuhan’ menjadi Perdana Menteri, sudah tentu masalah-masalah negara saperti “kemiskinan rakyat yang masih berleluasa di Sabah, Sarawak dan Semenanjung, masalah rasuah yang semakin membarah, keruntuhan moral (akhlak) dan pelbagai penyakit sosial yang semakin kronik, penyalahgunaan kuasa yang berwewenang, hutang negara yang semakin bertambah, track record kerendahan moral dan akhlak” dapat diselesaikan dengan mudah. Rakyat akan dipupuk menjadi masyarakat madani. Negara menjadi sebuah Utopia berkat mukjizat ‘anugerah Tuhan’ ini.

Keadilan dan ketulusan akan berleluasa, tidak timbul kisah pemecatan melalui surat palsu. Kebebasan media dinobatkan tanpa ganggu-gugat dari “Empat Budak Melayu”. Harmoni antara kaum akan membungar hasil usaha Biro Tata Negara. Suruhanjaya Pilihan Raya diperkemas supaya pemilihan dapat diadakan tanpa kepincangan, penyelewengan dan tuduhan berat sebelah. Pelaburan terus luar negara, terutama dari Timur Tengah, akan mendadak naik.

Pemimpin ini ialah anugerah Tuhan kepada semua rakyat Malaysia. Di mana keadilan jika setakat ini hanya Azizan, Sukma dan Saiful Bukhari sahaja yang dapat menikmati anu ‘anugerah Tuhan’ ini?

PKR's deplorable attitude towards dissent and criticisms - Muniandy Vengaiah

I was one of those PKR members who went on the morning of 27th November to the Petaling Jaya Civic Hall to express openly our disagreement and dissatisfaction with the way the party elections has been conducted and its failure to be clean and fair. Our intention was to demonstrate peacefully and in an orderly manner without disturbing the public or anyone in particular.

However, I was very disappointed and saddened to observe how nowadays PKR would respond to any display by party members of any stand or opinion which differs or is not in line with what the party wants.

I had participated before in the Reformasi street demonstrations of 1998-2002 protesting against the injustices committed by the Mahathir regime on Anwar Ibrahim and couldn’t help comparing what happened on 27 November to what I witnessed during the Reformasi demonstrations of 1998-2002.

PKR which was born from the spirit of defiance and in protest against injustice is expected to be understanding and tolerant of peaceful demonstrations which are just open expressions of dissatisfaction and unhappiness. What more when we the demonstrators are its own party members, not from Umno or MIC or MCA or any BN party.

However, it did not turn out that way. The response from the party was not far different from the way the police or FRU acted during the 1998-2002 street demonstrations.

Our banners and posters were seized from us by members of the PKR security squad, just like what the police did back in the 1998-2002 street protests.

Our demonstration though peaceful and orderly was met with hostility by the party. We were subjected to verbal abuse, harassed and prevented from gathering at the public space we wanted.

Members of the media who were just doing their professional duty in covering and recording our demonstration were yelled at and threatened to stop their coverage.

Some of us were roughed up as soon as our intention to demonstrate at the congress venue was known.

In short, if PKR that morning of 27th November had water cannons or tear gas or the FRU at their disposal, I am convinced it would not have hesitated to use all those to disperse or suppress our peaceful demonstration.

This is what PKR has come to nowadays. A party which was supposed to uphold and practice the ideals of free speech and free press clearly has forgotten those ideals. What is the cause of this loss in direction? If a fish rots from its head, I dare say PKR is now rotting because of its leadership which is drunk and obsessed with gaining the reins of government, so much so that it has forgotten the original aims of the party which was to reform and bring genuine change to the country for the sake of our children and grandchildren.

To me, PKR now is not much different from BN/Umno. The date 27 November 2010 is one which really saddens me.

Kecewa sikap parti terhadap bantahan dan kritikan - Muniandy Vengaiah

Saya adalah salah seorang dari ahli-ahli PKR yang telah pergi pada pagi 27 November ke Dewan Sivik Petaling Jaya untuk menyuarakan secara terbuka bantahan dan perasaan tidak puas hati kami terhadap salahlaku perjalanan pemilihan PKR yang gagal dikendalikan secara adil dan bersih.

Tujuan kami adalah untuk menunjuk perasaan dengan aman, teratur dan tidak menganggu ketenteraman awam atau sesiapa pun.

Sesungguhnya saya merasa amat kecewa dan sedih melihat cara PKR sekarang ini bertindak kepada mana-mana ahli yang menunjukkan pendirian atau pendapat yang tidak sehala atau selari dengan apa parti hendakkan.

Saya pernah mengambil bahagian dalam demonstrasi jalanan Reformasi tahun 1998-2002 yang membantah kezaliman rejim Mahathir ke atas Anwar Ibrahim dan mahu tak mahu saya terpaksa membuat perbandingan apa yang berlaku pada pagi 27 November 2010 dengan apa yang telah saya saksikan semasa demonstrasi Reformasi 1998-2002.

Parti yang telah lahir daripada semangat membantah dan menentang ketidakadilan sepatutnya memahami dan bertoleransi terhadap apa-apa demonstrasi aman bagi meluahkan perasaan tidak puas hati. Apatah lagi kami yang berdemonstrasi adalah ahli-ahli PKR sendiri, bukannya Umno atau MIC atau MCA atau mana-mana parti BN.

Ini tidak. PKR telah bertindak mirip seperti pihak polis atau FRU semasa demonstrasi jalananan 1998-2002.

Kain-kain sepanduk dan rentang hak kepunyaan kami telah dirampas oleh skuad sekuriti PKR, sama seperti apa yang polis buat 1998-2002 dahulu.

Kehadiran penunjuk perasaan walaupun aman dan teratur amat tidak disenangi oleh parti. Kami telah dihalau dan dimaki hamun.

Pihak media yang menjalankan tugas dan membuat liputan demonstrasi kami juga tidak disenangi oleh parti. Mereka telah diherdik dan diugut supaya memberhentikan liputan mereka.

Ada di kalangan kami telah dikasari sebaik sahaja tujuan kami berada berhampiran tempat kongres diketahui oleh parti.

Pendek kata, sekiranya PKR pada pagi 27 November tersebut mempunyai ‘water cannon’ atau gas pemedih mata atau FRU dibawah telunjuk mereka, saya pasti mereka tidak akan berlengah-lengah untuk menggunakan semua itu bagi menyuraikan demonstrasi kami.

Inilah PKR hari ini. Sebuah parti yang sepatutnya mempunyai idealisma untuk mempertahan dan mengamalkan kebebasan bersuara dan media sekarang jelas telah terlupa akan idealisma tersebut. Apakah punca kehilangan haluan ini? Kalau ikan menjadi busuk dari kepalanya, berani saya katakan PKR kini menjadi busuk berpunca dari kepimpinannya yang kini mabuk dan kemaruk untuk memegang tampuk pemerintahan negara sehingga terlupa matlamat asal parti iaitu untuk membawa Reformasi dan perubahan kepada negara demi nasib anak cucu kita semua.

Pada saya, PKR sekarang tidak ubah seperti BN/Umno sahaja. Tarikh 27 November 2010 adalah satu yang amat menyedihkan bagi saya.

Wither the Indians in PKR? - Muniandy Vengaiah

At the turn of the last century, our forefathers were kidnapped from India by the British and brought to this land as indentured labourers. They formed the bulk of the tappers in the rubber estates, the coolies in the road and rail building gangs and the menial workers in the local councils. Later they were joined by other immigrants from the sub-continent to serve in the civil, health, education, legal services and the police force. Together with the other communities, they helped build this nation which they, and we now call home. Today, ethnic Indians make-up 7.1% of the total population. A minority but a sizable one.

There is no Indian-dominated parliamentary constituency. However, there are many constituencies where Indians hold the decisive votes. Indians are 6.8% of registered voters but they do not have an effective political representation. MIC have been hijacked by the Samy Vellu mafioso, Gerakan regard Indians as a joke, Indians are second-class members in DAP while IPF, PPP, HRP, Makhal Sakti, etc. are only interested in vying for the Indian quota on the BN gravy train.

Events after the Hindraf-sponsored demonstrations in 2007 raised our political consciousness. We were made aware that we did not have political representation. We discarded MIC, rejected BN and looked to PKR in particular, and PR in general to represent us politically. We registered in droves as PKR members such that 25% of PKR members now are ethnic Indians. Cometh GE12, we threw our support to PKR and PR.

Two and a half years after the tsunami, the political fortunes of the Malaysian Indians have not changed for the better. The Indian underclass is still ignored. The grievances of the Indian community are still summarily dismissed. Even in PR controlled states, Indians fare no better: Hindu temples are demolished in Selangor, Indian squatters are evicted without proper compensation in Penang.

The idea of a multi-racial political party was appealing. We hoped that in such an environment the minority would be given enough space. We prayed that a leader who had suffered injustice would empathize with the injustice we are facing. Alas, our hopes and dreams are dashed.

Events in PKR lately have proven that Indians are still marginalized. No Indian was elected to the MPP in the recent party elections. Token Indian leaders would be appointed to fill the quota: self-serving leaders whose primary interest is to hang-on to Anwar’s coat-tail in the march to Putrajaya.

The future of the Indians in PKR is bleak. A PKR where the incoming deputy president had brazenly called another PKR leader of Indian origin, a pariah.

It is time that we Indians, as a community, re-evaluate our support for PKR. Indian members of PKR should not be taken for granted. We should suspend our membership en-masse until the leadership of PKR make serious amends to earn our support. Being a direct member of BN, by-passing MIC, PPP, Gerakan and the likes, is always a viable alternative. The so-called "Third-Force" could be an option too, but it is an option we should carefully evaluate.

Anugerah Tuhan - Abas Azizan

Sungguh terharu hati saya apabila mendengar presiden PKR mengatakan bahawa ketua umum PKR, Datuk Seri Anwar Ibrahim, adalah ‘anugerah Tuhan’. Memang banyak harungan dan cabaran hidup, mahupun kezaliman yang telah dilalui dan dihadapi oleh Datuk Seri Anwar. Setiap cabaran itu telah beliau hadapi dan tangani dengan penuh tekad dan tabah. Ketokohan beliau menyerlah setiap kali.

Bagaimanapun, perasaan terharu itu, apabila saya fikirkan dengan mendalam, mahu tak mahu, bercampur aduk juga dengan sedikit kekhuatiran.

Sememangnya Wan Azizah seorang isteri yang setia, yang mahu berdiri teguh di samping suaminya yang sekarang ini melalui kegetiran samada di arena politik negara ataupun di arena peribadi. Hakikat itu saya terima. Apa yang saya bimbang dan khuatirkan adalah dengan mengangkat Anwar sebegitu rupa, perkataan Azizah akan disalahtafsirkan sebagai mendewa-dewakan Anwar seolah Anwar adalah seorang yang maksum dan tidak pernah melakukan kesalahan. Sekiranya tanggapan ‘Anwar maksum’ ini menjadi realiti, itu adalah satu perkembangan yang amat tidak sihat di kalangan pengikut-pengikut Anwar.

Sayugia diingatkan, sebenarnya Anwar juga pernah melakukan kesilapan – banyak kesilapan di dalam likar-liku kehidupan beliau. Jauh sekali dari maksum ’anugerah Tuhan’ ini.

Beliau tersilap apabila gemar sangat menggaji orang-orang muda yang handsome dan tinggi lampai sebagai kakitangan pejabat beliau. Setelah pernah difitnah oleh Mahathir dengan dituduh dan dipenjara atas kesalahan seks luar tabii atau seks homoseksual, adalah silap untuk Anwar sekali lagi membiarkan pemuda-pemuda tinggi lampai dan handsome berkeliaran di pejabat beliau. Peluang telah terbuka untuk apa yang terjadi sebelumnya terjadi sekali lagi. Nah, sekarang timbul pula Sodomi 2!

Anwar tersilap apabila meminta maaf kepada beberapa pendokong Zionisma semasa melawat Amerika Syarikat beberapa bulan lepas. Kenapa perlu beliau meminta maaf tidak pula pernah diperjelaskan olehnya kepada rakyat di Malaysia. Beliau juga telah jelas tersilap sekiranya memikirkan laporan beliau meminta maaf itu tidak akan sampai ke telinga orang di Malaysia.

Anwar juga telah tersilap mengenai kes 16 September 2008. Tidaklah diketahui dan tak pernah pula beliau memberi penjelasan atas asas apa yang beliau percaya 30 orang wakil rakyat BN akan dapat dipengaruhi untuk melompat masuk ke Pakatan Rakyat dan seterusnya membuka laluan untuk Anwar menjadi perdana menteri negara.

Anwar telah mengumumkan, sebaik sahaja dilantik menjadi penasihat ekonomi negeri Selangor, bahawa beliau akan membawa berbilion-bilion wang pelaburan dari Timur Tengah ke negeri Selangor. Ini nampaknya adalah satu kesilapan sebab sehingga kini tak kelihatan pun pelaburan dari Timur Tengah itu.

Ini tidak lagi termasuk kesilapan-kesilapan yang pernah Anwar lakukan semasa beliau berada di dalam parti Umno. Dan sekira difikirkan betul-betul, kemasukan beliau ke dalam Umno dahulu itu pun boleh dianggap sebagai satu kesilapan. Mana pula boleh seorang ‘anugerah Tuhan’ masuk parti sekular? Insan yang sedemikian sewajarnya masuk ke parti yang sentiasa berusaha untuk redha Tuhan, iaitu PAS.

Menuntut Penjelasan Daripada YB Saifuddin Nasution Ismail - Abdul Aziz Anon

Belum sempat kering luka-duka pemilihan PKR selepas 6 bulan yang begitu menyakitkan, selepas kami akur menghormati parti dengan memejam mata kepada salahlaku pemilihan PKR, selepas melihat pimpinan mengiktiraf ketidakadilan menyelubungi pemilihan PKR, PKR diserang lagi. Satu demi satu isu melibatkan parti ditimbulkan. Kali ini bekas Setiausaha Agung, Dato’ Salehuddin Hashim mendakwa Ibu Pejabat parti telah menggunakan nama dan tandatangan beliau untuk mengeluarkan satu surat palsu yang dijadikan bukti untuk menghalang Jenapala dari bertanding jawatan timbalan presiden semasa pemilihan baru-baru ini.

Jika benar dakwaan Dato’ Salehuddin, maka parti akan sekali lagi berdepan dengan permasalahan. Imej parti akan bertambah buruk dan kredibiliti parti akan tercemar lagi.

Menggunakan tandatangan dan nama orang lain adalah salah, pecah amanah dan jenayah. Saya percaya Ibu Pejabat tidak seberani itu untuk memalsukan tandatangan dan nama orang lain, apatah lagi nama seorang Setiausaha Agung secara memandai-mandai. Tetapi sesudah melihat bagaimana Ibu Pejabat mengendalikan pemilihan PKR, saya mula ragu-ragu kebarangkalian wujudnya kebodohan yang memberanikan Ibu Pejabat Parti untuk bertindak sedemikian.

Minit mesyuarat Biro Politik pada 30 Ogos 2009 menunjukkan kes Jenapala masih lagi dibincangkan. Ini bermakna Jenapala masih lagi anggota parti. Surat pemecatan Jenapala pula bertarikh 2 Febuari 2009. Pimpinan parti hingga sekarang seolah terkelu lidah dan terus membisu, enggan memberi penjelasan barang secebis pun bagaimana percanggahan tarikh ini boleh timbul.

Secacat-cacat surat pecat yang pernah saya tengok, tiada yang secacat surat yang membuang Jenapala dari jadi ahli. Mesyuarat MPP mana satu yang memutuskan untuk dia dipecat pun tidak dinyatakan dalam surat itu! Itu sahaja sepatutnya sudah cukup asas untuk mencurigai kesahihan surat itu. Tidakkah surat itu dibelek dan diusulperiksa oleh YB Saifuddin sebelum dia mengetengahkan surat itu kepada pihak mahkamah sebagai sebahagian dari afidavit balas beliau?

Melihat dakwaan dengan fakta yang dikemukakan dan keengganan Parti untuk memberi hujah balas mengenai fakta-fakta tersebut, semuanya mengundang kegelisahan ramai ahli bawahan dan penyokong parti tentang apa sebenarnya yang berlaku.

Apakah benar Ibu Pejabat menggunakan nama dan tandatangan Dato’ Salehuddin untuk mengeluarkan surat palsu? Jika benar, siapakah yang bertanggungjawab?

Dakwaan dan salahlaku sebegini amat serius dan bukanlah perkara yang boleh diambil enteng. Apatah lagi PKR sebagai sebuah parti reformasi gerakan rakyat yang menjunjung nilai-nilai murni. Lebih malang lagi perkara-perkara sebegini mengundang pihak polis untuk bertandang di dalam Ibu Pejabat parti dan boleh mengheret parti ke mahkamah. Satu-persatu isu akan timbul dan sudah tentu akan menjejaskan kredibiliti parti serta menghakis keyakinan rakyat dan ahli-ahli.

Peringatan saya kepada pemimpin parti bahawa di dalam Pakatan Rakyat, PKR adalah yang paling lemah. Lemah dari segenap aspek berbanding PAS dan DAP. Satu persatu cerita negatif PKR menjadi sensasi politik. Sudah tentu tempiasnya juga memberi kesan kepada PAS dan DAP. Sekiranya cerita buruk PKR timbul berterus-terusan, tentu ini akan mengundang kemarahan PAS dan DAP.

Oleh itu, Setiausaha Agung, Sdr YB Saifuddin Nasution hendaklah menjelaskan kepada semua ahli dan penyokong parti: apakah sebenarnya yang telah berlaku?

Kenyataan Media bekas SUA PKR mengenai pemalsuan surat pemecatan S. Jenapala

1. Saya memanggil sidang media ini untuk menjawab beberapa perkara yang dibangkitkan oleh pegawai-pegawai PKR berhubung dengan laporan polis yang telah saya buat Jumaat lepas berkenaan pemalsuan surat yang dikeluarkan menggunakan nama dan tandatangan saya sebagai Setiausaha Agung PKR pada 2hb Februari 2009.

2. Surat tersebut telah digunakan di dalam afidavit daripada Saifuddin Nasution, Setiausaha Agung PKR sekarang ini, sebagai bukti pemecatan keanggotaan parti S. Jenapala untuk menghalang beliau dari bertanding dalam pemilihan PKR baru-baru ini.

3. Saya tidak ambil peduli sama ada S. Jenapala layak atau tidak untuk bertanding tetapi saya amat mengambil berat apabila nama dan jawatan yang saya pegang telah digunakan untuk tujuan mencipta bukti palsu bahawa seorang ahli telah dipecat oleh saya.

4. Memandangkan perkara ini telah dibawa ke perhatian pihak polis, saya serahkan kepada mereka untuk menyiasat. Saya sukacita mengambil maklum bahawa beberapa pegawai PKR telah menyatakan mereka akan bekerjasama penuh dengan polis, tidak seperti Tian Chua yang seakan melantik dirinya sebagai jurucakap pihak polis dengan mengatakan polis tidak berminat dengan butir-butir teknikal kes ini. Ingin saya ingatkan semua pihak bahawa butiran-butiran kecillah yang memberi gambaran besar, dan kegagalan untuk memberi perhatian yang sewajarnya kepada butiran-butiran telah mengakibatkan kawalan dan pengurusan pemilihan parti baru-baru ini amat lemah.

5. Surat yang kononnya dikeluarkan oleh saya itu adalah membatasi peruntukan perlembagaan parti (ultra vires). Tidak ada individu di dalam parti yang boleh secara bersendirian memecat keahlian seseorang. Presiden parti pun tidak ada kuasa sedemikian. Surat itu tidak menyatakan sama ada pemecatan tersebut telah dipertimbang dan diputuskan oleh Majlis Pimpinan Tertinggi (sekarang digelar Majlis Pimpinan Pusat atau MPP) dan saya, sebagai setiausaha agung, telah diarah untuk memaklumkan kepada ahli tersebut akan pemecatan beliau. Amalannya adalah MPT akan menyerahkan sesuatu kes disiplin kepada Jawatankuasa Disiplin untuk disiasat dan jawatankuasa tersebut seterusnya akan menyerahkan hasil siasatan dan saranannya. Semua itu akan termaktub di dalam minit mesyuarat MPT. Juga, minit MPT akan menunjukkan sama ada terdapatnya atau tidak arahan kepada saya untuk memecat, memandangkan ada dakwaan oleh pegawai-pegawai PKR bahawa saya telah tidak mengendahkan arahan untuk membuat pemecatan.

6. Tidak ada minit sedemikian bagi semua mesyuarat MPT untuk tahun 2009. Bagaimanapun, di dalam minit mesyuarat Biro Politik, iaitu biro yang mengurus perjalanan harian parti bagi pihak MPT, terdapat minit bertarikh 30hb Ogos 2009 yang menyatakan biro sedang mempertimbangkan tindakan disiplin ke atas S. Jenapala dengan menggantung keahlian beliau dan biro telah mengarahkan Jawatankuasa Disiplin untuk menyiasat sama ada benar dakwaan dia terbabit dalam aktiviti yang memudaratkan parti bagi tindakan disiplin yang sewajarnya diambil. Ini adalah prosedur operasi rasmi.

7. Yang menjadi persoalan besar adalah kenapa Biro Politik mempertimbangkan tindakan disiplin ke atas S. Jenapala tujuh bulan SELEPAS dia dikatakan telah dipecat oleh saya melalui surat yang bertarikh 2 Febuari 2009 itu? Sebenarnya S. Jenapala semasa itu masih lagi seorang ahli parti dan tidak pernah dipecat. Ini jelas kelihatan apabila beliau turut serta dalam beberapa majlis dan ceramah parti yang turut dihadiri oleh pucuk pimpinan tertinggi parti.

8. Walau apa sekalipun, surat tersebut adalah ultra vires kepada perlembagaan parti dan tidak boleh dikuatkuasakan. Saya fikir S. Jenapala akan mengambil tindakan serta-merta terhadap surat tersebut jika benar beliau telah menerimanya.

9. Mana-mana setiausaha agung yang punyai maruah diri dan membuat kerjanya dengan teliti tentunya akan ‘terkejut’ jika dia ‘terjumpa surat dalam fail’.

10. Saya tidak menafikan surat tersebut mempunyai imej tandatangan digital saya yang digunakan untuk mencetak beribu-ribu surat pekeliling. Melalui surat-surat inilah saya berhubung dengan lebih daripada 200 cabang dalam parti. Maka surat pemecatan ini mungkin satu perbuatan ‘potong dan tampal’ (cut and paste), atau penyalahgunaan tandatangan digital saya yang terdapat dalam fail. Saya serahkan perkara ini untuk siasatan pihak polis.

11. Hakikatnya, saya tidak pernah mengeluarkan surat sedemikian ataupun meluluskan kandungannya, dan saya tidak pernah mengarahkan sesiapa untuk mengeluarkan surat demikian bagi pihak saya.

12. Kebimbangan peribadi saya ialah penggunaan nama saya secara sengaja untuk melakukan penipuan. Tetapi kebimbangan yang lebih besar bagi saya, sebagai seorang aktivis dalam pergerakan reformasi ialah; sebuah parti yang kononnya parti reformis telah terjebak ke dalam perangkap penyalahgunaan sekretariat parti (sebuah badan dibawah kuasa penuhnya) untuk mendapat kuasa dengan seberapa segera dengan mencabul hak-hak ahli partinya sendiri. Sebagai sebuah parti yang kerap menuduh orang lain menyalahgunakan kuasa, ada baiknya PKR dan ahli-ahlinya menyumbang ke arah perjuangan reformasi dengan meneliti ketelusan pimpinannya sendiri.

13. Semua penyalahgunaan kuasa secara besar-besaran yang kita lihat hari ini tidak berlaku secara tiba-tiba. Ianya berputik dengan salahlaku-salahlaku kecil, seperti yang saya ketengahkan hari ini. Sekiranya tiada apa dilakukan, akhirnya alah bisa, tegar biasa.

The strange case of Selangor Government vs Karim Munisar - Pandak Tukan

As a Selangor resident, I am perplexed by the situation at Kumpulan Darul Ehsan Berhad (KDEB), the investment arm of the Selangor state government, or more precisely, by the status of its president, Datuk Abdul Karim Munisar (DAKM).

As reported by the Sun on November 24th, DAKM is supposed to have ended his tenure in September this year, in accordance with his contract. However, till now, more than two months after his contract has expired, he continues to perform his duties as KDEB president, apparently against the wishes of his employer, the Selangor state government.

It really pains me to see the government of the most industrialised state in the federation having a tremendously difficult time managing a matter which other less developed states and even private corporations can handle with the greatest of ease and as a matter of course. An employee has finished his contracted tenure with you. What on earth can be so difficult about telling him that his services are no longer needed and that he need not show up at the office any more?

The explanation offered by the Selangor Menteri Besar’s (MB) political secretary was an insult to everyone involved and the public.

She said the termination letter written by the MB to DAKM may have been ambiguous to the latter. Is she saying the MB, despite so many years of corporate experience under his belt, is such a poor letter writer that DAKM couldn’t understand the point of his letter? Is she saying that DAKM, the president of KDEB, is such a poor reader that he couldn’t grasp it was a termination letter? Is she saying that DAKM is such a poor manager that having read the letter and not understanding it, he didn’t make an effort to get clarification from his ultimate boss, the MB?

Her attributing to Malay and Eastern culture the ‘difficulty’ in telling DAKM that his services is no longer needed is indeed astonishing and insulting to Malays and all those of Eastern culture. For heaven’s sake, woman! Thousands of private and public sector employees, from the lowliest to the most senior, up and down the country, year in and year out, have had their contracts not renewed for whatever reason. It is not rocket science the method to tell an employee politely yet clearly that his or her services are no longer needed.

All these I find particularly worrying as the state government laudably aspires to uphold ‘Ketuanan Rakyat’ and yet it finds it so troublesome to be a ‘Tuan’ to one of its own employees, notwithstanding that the employee in question is very senior. How can it hope to translate ‘Ketuanan Rakyat’ to reality if even the most basic tasks of government it cannot perform?

Moreover, the state has potentially bruising battles ahead with regard to the consolidation of the water concessionaires and other issues related to those concessionaires. How can the rakyat have the confidence that the state can handle those issues competently and with public interests well protected if a straightforward issue such as the termination of service of a contract employee can present immense difficulties to the state government?

The longer this DAKM issue persists, the greater and more prominent will be the embarrassment to the state government. I urge the MB to resolve the matter with the greatest urgency lest the question mark over his competence gets bigger and bigger.
